This Privacy Policy explains what personal data Moderandi, operated by Signitiva LLC ("Moderandi," "we," "us"), a Texas limited liability company based in Houston, Texas, USA, collects through the moderandi.com website, the Moderandi applications, and the signup and billing process; how we use it; and the choices you have.
1) Who we are, and two roles we play
For data collected through our website, signup, marketing, and billing — the data described in Sections 2.1, 2.5, 2.6, and 2.7 — Moderandi is the data controller.
For data that our Customers and their Authorized Users enter into the platform — their customers, orders, invoices, deliveries, routes, photos, signatures, portal end-users — the Customer is the data controller and Moderandi is a processor acting on the Customer's instructions under our Data Processing Agreement. Requests about that data should go first to the Customer that controls it; we assist Customers in fulfilling them.
2) Information we collect
2.1 Information you provide
Account and signup details. When you request a demo, create an account, or start a trial, we collect your name, email address, phone number, and company name, plus account details such as password hashes and role assignments, and organizational information such as billing details and tax IDs. Signup details are stored in Signitiva's customer relationship management (CRM) system, which we use to manage signups, trials, and customer relationships.
Unfinished signups are deleted after 72 hours, along with the details entered.
Communications. Support requests, feedback, and messages you send us.
2.2 Information collected automatically
Device and app data (OS type, app version, crash logs), usage analytics (screens viewed, features accessed, timestamps, performance metrics), server logs (IP address, browser type, pages visited), and approximate location derived from IP address for security purposes.
2.3 Location data (mobile app)
Precise GPS coordinates are collected during active route usage for tracking, check-ins, proof-of-visit, and ETA analytics. Background location tracking requires explicit enablement by the Customer organization and device-level permission. You can disable location in your device settings; your organization's tracking requirements may apply to work devices. Customers are responsible for the notices and consents this requires (Section 12).
2.4 Information from third parties
Payment processors (tokenized payment details and transaction status), mapping providers (geocoding and routing outputs), and integrations the Customer enables (ERP/CRM systems, email/SMS/WhatsApp providers, identity services such as Google or Microsoft sign-in).
2.5 How you found us
The website stores, in your own browser (local storage, not our servers), information about how you arrived — advertising campaign tags (such as UTM parameters) and the referring site — for up to 90 days. If you sign up within that period, we read this stored information to attribute the signup to its source. You can clear it at any time by clearing your browser's site data, and where your local law requires consent for this storage, we ask for it before storing.
2.6 Human verification
Our contact and signup forms are protected by Cloudflare's Turnstile ("are you human") check. Cloudflare processes technical data such as your IP address and browser characteristics to distinguish people from bots.
2.7 Payments and acceptance records
Card payments are processed by Stripe. Your card details go directly to Stripe; we never receive or store your full card numbers. We receive confirmation of payment, the last four digits of the card, and the billing details needed for invoicing and tax.
When you accept a subscription agreement online, we record the accepting user, the date and time, the IP address, the version of the agreement accepted, and the "Last updated" date of this Privacy Policy then in force. We keep these records as evidence of the contract.
3) How we use information
We use the information above to: operate the Services (account management, routing, dispatching, proof-of-delivery, collections, customer portals); process signups, trials, payments, and renewals; attribute signups to marketing sources; improve performance (debugging, analytics, feature development); secure our systems (fraud and abuse prevention, access controls, bot protection); send service communications (password resets, security alerts, trial and renewal reminders, billing notices); provide support; comply with legal obligations; and establish and defend legal claims. Aggregated, de-identified data may be used to analyze usage trends.
We do not sell personal data, we do not share it for cross-context behavioral advertising, and we do not use it for third-party advertising.
4) Legal bases (EEA, UK, and similar jurisdictions)
Where laws such as the GDPR apply, we process personal data on these bases: performance of a contract (providing the Services, processing signups and payments); legitimate interests (security, fraud prevention, marketing attribution, support, service improvement); consent where required (location features, marketing emails, browser-stored attribution, optional cookies); and legal obligation (tax, accounting, regulatory requirements).
5) How we share information
5.1 With your organization. If you use Moderandi as an Authorized User, your account and activity data (route performance, check-ins, notes, customer interactions, and location tracking where enabled) is visible to your organization's Admins according to its configured settings.
5.2 Service providers. We share personal data with providers that help us run the website and Services under contracts restricting their use of it — including Google Cloud Platform (hosting, US East), Stripe (payments), Cloudflare (bot protection and site security), Resend (transactional email), Anthropic and Deep Infra (AI-assisted features, for subscribed customers), and Signitiva's CRM system (signup and customer contact details). The current, authoritative list of platform subprocessors, with locations, is maintained at moderandi.com/legal/subprocessors.
5.3 Integrations you enable. Connected third-party tools receive the data necessary for the integration to work, under their own terms.
5.4 Legal and safety. We disclose information where required by law, subpoena, or legal process; to protect the rights and safety of Moderandi, our Customers, or others; to investigate fraud or security incidents; or to enforce our agreements.
5.5 Business transfers. In a merger, acquisition, financing, or sale of assets, information may be transferred with appropriate protections and notice.
6) Cookies and similar technologies
We use cookies and similar technologies to maintain sessions and security, remember preferences, and measure how the site is used. Essential cookies are required for the site to function. The browser-stored attribution described in Section 2.5 is first-party local storage with a 90-day lifetime; we do not use third-party advertising cookies. You can control cookies and site data through your browser settings, and where your jurisdiction requires consent for non-essential storage, we request it before placing it.
7) Data retention
We keep personal data only as long as needed: unfinished signups — 72 hours; browser-stored attribution — up to 90 days, in your browser; agreement-acceptance records — for as long as needed to evidence the contract and defend claims; account, CRM, and billing data — for the life of the relationship plus the periods required for tax, accounting, and legal purposes; platform Customer Data — per the Customer's subscription terms, including the export and deletion windows in the Contract and Billing Terms and the Data Processing Agreement. Data retained in routine backups expires on the backups' normal schedule.
8) Security
We protect personal data with administrative, technical, and organizational safeguards, including encryption in transit, role-based access controls, tenant isolation, and audit logging, as described in the security annex of our Data Processing Agreement. No system is completely secure; please use strong passwords and protect your devices. To report a security concern, contact security@moderandi.com.
9) Your rights and choices
You can update your account details in the app or portal; organization Admins manage user profiles and permissions. Marketing emails include an unsubscribe link; service and billing notices continue while you have an account. Device location permissions can be disabled in your device settings.
Depending on where you live — including the EEA and UK (GDPR), Brazil (LGPD), and US states with privacy laws (such as California) — you may have rights to access, correct, delete, or receive a copy of your personal data, to object to or restrict certain processing, to withdraw consent, and to not be discriminated against for exercising these rights. To exercise them, contact privacy@moderandi.com; we will verify your request and respond within the time your local law requires. Where a Moderandi Customer controls the data (platform data), please direct your request first to that Customer; we assist Customers in fulfilling applicable requests. You may also lodge a complaint with your local data-protection authority.
10) International data transfers
We are based in, and process data in, the United States. If you access the Services from outside the US, your data is transferred to and processed in the US. Where your local law requires safeguards for international transfers, we rely on appropriate contractual protections — including the Standard Contractual Clauses and equivalent mechanisms described in our Data Processing Agreement — with our Customers and providers.
11) Children's privacy
The Services are for business use and are intended for users aged 13 or older (or the higher minimum age your jurisdiction sets). We do not knowingly collect personal data from children; if you believe a child has provided us data, contact privacy@moderandi.com and we will delete it.
12) Customer responsibilities
Customers using Moderandi for their operations must provide appropriate notices to, and obtain any required consents from, their employees, contractors, and end customers — including for location tracking, monitoring, communications, and payments — and must ensure their use of the Services complies with applicable privacy, labor, and consumer-protection laws.
13) Changes to this policy
When we change this policy, we update the "Last updated" date at the top and publish the revised version at this address. We notify account holders of material changes through the Service or by email. The signup system records which version of this policy was in force at each agreement acceptance.
